1. Introduction

These Terms and Conditions govern the access to and use of the services provided by PetAvatar3D (hereinafter referred to as “PetAvatar3D”, “we”, “our”, or “the company”).

PetAvatar3D provides digital services consisting of the creation of personalized 3D models of pets and augmented reality (AR) viewing experiences.

By using our services, submitting images, or placing an order, the user agrees to these Terms and Conditions.

3. Description of the Service

PetAvatar3D offers digital services that may include:

Creation of custom 3D models of pets
Augmented reality (AR) visualization
Delivery of digital 3D model files
Interactive experiences related to the 3D model

To create the model, the customer must provide photos or videos of their pet.

The final result will depend on the quality, quantity, and angles of the images provided.

4. Order Process

Customers may request the service through:

the website
social media
email
other platforms authorized by PetAvatar3D

Once the order is confirmed and payment is received, PetAvatar3D will begin creating the model.

When the process is completed, the customer will receive access to the model or the corresponding experience.

5. Pricing and Payments

Prices will be communicated to the customer before confirming the order.

Payments may be made through:

online payment platforms
external payment providers
other payment methods indicated during the purchase process

PetAvatar3D does not store full credit card information.

6. Customized Products

The 3D models offered by PetAvatar3D are custom-made products created specifically for each customer.

According to European consumer protection regulations, personalized digital products are not eligible for withdrawal once the creation process has started.

7. Model Quality and Limitations

The 3D model is generated based on the images provided by the customer.

Therefore, the final quality may depend on factors such as:

image quality
lighting conditions
camera angles
amount of visual reference material provided

PetAvatar3D will make reasonable efforts to accurately represent the pet but cannot guarantee a perfect reproduction.

8. Use of Submitted Images

The customer confirms that:

they own the images submitted, or
they have the legal right to use them.

By submitting images, the customer grants PetAvatar3D permission to use them solely for the purpose of creating the requested 3D model and completing the order.

Images will not be used for other purposes without prior consent.

9. Promotional Use of Models

PetAvatar3D may use renders or images of the generated 3D models for promotional purposes, including:

portfolio
social media
marketing materials

If the customer does not wish their model to be used for promotional purposes, they must notify PetAvatar3D in advance.

10. Model Availability and Service Access

PetAvatar3D will provide access to the 3D model and its augmented reality visualization through its servers for a minimum period of twelve (12) months from the delivery of the service.

During this period, PetAvatar3D will make reasonable efforts to maintain the availability of the service.

After this period, PetAvatar3D does not guarantee permanent hosting or access to the model through its servers.

If the hosting or AR visualization service becomes unavailable for any reason, including technological changes, service modifications, or company closure, PetAvatar3D will, whenever technically possible, provide the customer with a copy of the 3D model in a standard format (.GLB) or an equivalent format for personal use outside the platform.

The delivery of the digital 3D model file will be considered the full completion of the contracted service.

11. User Conduct

Customers agree not to submit content that:

infringes third-party rights
is illegal
is offensive or inappropriate

PetAvatar3D reserves the right to refuse orders containing inappropriate content.

12. Intellectual Property

All intellectual property rights related to the technology, software, and processes used to create the 3D models belong to PetAvatar3D.

The customer receives a personal, non-commercial license to use the generated model.

Customers may not:

resell the model
distribute it commercially
modify it for commercial purposes

without explicit permission from PetAvatar3D.

13. Service Availability

PetAvatar3D will make reasonable efforts to maintain service availability.

However, the service may be interrupted due to:

maintenance
technical issues
network failures
third-party services

PetAvatar3D does not guarantee uninterrupted service availability.

14. Limitation of Liability

To the maximum extent permitted by law, PetAvatar3D shall not be liable for:

indirect damages
data loss
misuse of the model by the customer
failures caused by third-party services

PetAvatar3D’s maximum liability related to any claim shall be limited to the amount paid by the customer for the service.

15. Data Protection

Personal data is processed in accordance with the General Data Protection Regulation (GDPR).

16. Changes to the Terms

PetAvatar3D reserves the right to modify these Terms and Conditions when necessary.

Changes will be published on the website and will take effect upon publication.

17. Governing Law

These Terms and Conditions shall be governed by the laws of Spain.

Any disputes arising from the use of the services will be subject to the competent courts according to applicable legislation.
